Q: Can our children collect EI when me and my brother are 50/50 owners? |
A: You and your brother form what is called (by the income tax act) a related group that controls the company. Thus, any people related to either you or your brother are excluded by the EI act until such time as the government (the minister) deems your children to deal with you at what they call arm's length. This means that they are NOT eligible until the minister allows them into the system, and they will protect the system as that is why this exclusion clause exists. Just ask any of the tax court judges who have rules on these issues! |
